What is a Trademark?

A trademark is a distinctive sign used to identify and differentiate the goods or sevices of one business from those of others. It may take the form of a logo, name, word, letters, numbers, color combinations, or any combination of visual and verbal elements tha create a brand's identity.

Types of Trademarks

Based on form

Word Mark

A trademark consisting solely of verbal elements, such as words, letters, numerals, or their combinations, without any graphical or logo elements.

Logomark

A trademark made up of non-verbal visual elements, such as a logo, illustration, symbol, or other graphic design, without words or letters.

Combined Mark

A trademark that combines verbal elements (words/letters) with visual elements (a logo, image, or graphic design).

Based on function

Trade Mark

A mark used to distinguish goods manufactured or traded by one party from similar goods offered by others. Under the NICE classification, goods are covered in classes 1-34.

Service Mark

A mark used to distinguish services provided by one party from similar services provided by others. Under the NICE classification, services are covered in classes 35-45 (service classes).

Collective Mark

A mark used by group, legal entity, or organization to distinguish the goods or services of its members from those of other parties.

Application Filing

The trademark is filed with the DGIP and assigned an application number and filing date.

Formality Examination

The authority reviews the applicant's details and verifies that the required information/documents are complete.

Publication Period

The trademark is published in the official trademark gazette. Third parties who believe they may be adversely affected may file an opposition.

Substantive Examination

An examiner assesses registrability under applicable law, including whether the mark is identical or confusingly similar to existing trademarks.

Registered

Once approved, the trademark is registered, a certificate number is issued, and protection takes effect.
